Please read these terms carefully before using our services or submitting a project inquiry. By contacting us, you agree to be bound by them.

Effective: September 12, 2026
Jurisdiction: Nainital, Uttarakhand, India
Entity: GDF Technologies
14 Sections
Section 01

Agreement to Terms

By accessing or using gdftechnologies.in, contacting us via WhatsApp or Telegram, or engaging GDF Technologies ("we", "us", "our") for any software development or design services, you ("Client", "you") agree to be bound by these Terms & Conditions.

If you do not agree with any part of these Terms, please discontinue use of our Site and services immediately. These Terms apply to all visitors, clients, and anyone who engages with our services.

GDF Technologies is an unregistered freelance/agency business operating from Nainital, Uttarakhand, India. These Terms form a legally binding agreement under the Indian Contract Act, 1872.

Section 02

Our Services

GDF Technologies provides the following software development and design services:

  • Android App Development (Kotlin, Java)
  • iOS App Development (Swift)
  • Cross-Platform Development (Flutter, React Native)
  • Backend & Cloud Infrastructure (Node.js, Python, AWS, GCP, Azure)
  • AI & Machine Learning Integration
  • Sketchware / Block-based Development
  • Enterprise Solutions (ERP, CRM, POS, SaaS)
  • UI/UX Design & Prototyping
  • App Store & Play Store Submission Support
  • Cloud Hosting & Maintenance

All services are subject to availability, project scope, and mutual agreement between GDF Technologies and the Client prior to commencement.

Section 03

Project Engagement

A project engagement is formally initiated only after both parties have mutually agreed on scope, timeline, and pricing through direct communication (WhatsApp, Telegram, or email) and an initial payment has been received.

The Client is responsible for:

  • Providing clear, accurate, and complete project requirements
  • Responding to queries and review requests within agreed timelines
  • Providing necessary credentials, assets, or third-party access required to complete the project
  • Reviewing and approving deliverables at each milestone

GDF Technologies reserves the right to decline any project request at its sole discretion.

Project Timelines — If we have previously developed a similar type of project, we can typically deliver a working APK within 7 to 10 days. For projects being built entirely from scratch that we have not worked on before, the standard delivery timeline is 2 to 3 weeks. All timelines are estimates and may vary based on project complexity and client responsiveness.

Section 04

Payment, EMI & Server Fees

All payments are handled offline or directly via WhatsApp/Telegram. No payment gateway is integrated on this website, and GDF Technologies does not collect payments through the Site.

Payment structures are agreed individually per project and may include:

  • Advance payment before project commencement
  • Milestone-based payment schedule
  • Equal Monthly Instalments (EMI), where offered
  • Final payment upon delivery of completed project

Accepted modes include bank transfer, UPI, and other methods as mutually agreed. All pricing is in Indian Rupees (INR) unless explicitly stated otherwise. Late payments may result in work being paused until payment is received.

EMI Instalments. Where a project is billed via EMI, the schedule, amount, and due dates are agreed at the time of engagement. If an instalment is not paid within 7 days of its due date, GDF Technologies may apply additional late charges and/or suspend the project and any associated services until the outstanding amount is paid in full. Suspension does not waive the Client's obligation to pay amounts already due.

Server & Hosting Fees. Where GDF Technologies manages server or hosting infrastructure on the Client's behalf, continued service is conditional on timely payment of the applicable server fee. If the fee is not paid by the renewal date, the associated project, website, or application may be suspended or taken offline until payment is received. GDF Technologies is not responsible for any loss, downtime, or damage arising from such suspension.

GDF Technologies may send automated email reminders for upcoming EMI instalments, server renewals, or other dues as a courtesy. These are provided for convenience only — the Client remains solely responsible for tracking and meeting all payment obligations regardless of whether a reminder is sent, received, or seen (including due to spam filters, incorrect contact details, or technical failures). Non-receipt of a reminder does not excuse late or missed payment.

Section 05

Refund & Cancellation Policy

NO REFUND POLICY — Once a project has commenced (i.e., work has begun following receipt of payment), no refund will be issued under any circumstances.

Prior to project commencement, if you wish to cancel an inquiry before any payment is made, you may do so freely at no cost.

Project commencement is defined as the moment GDF Technologies begins any design, development, research, or planning activity after receiving an initial payment.

In exceptional cases where GDF Technologies is unable to deliver the agreed scope due to internal reasons, a partial or full refund may be considered solely at our discretion on a case-by-case basis.

No refund will be issued where a project or service is terminated due to the Client's misconduct, including abusive, hateful, or threatening behaviour toward GDF Technologies or its staff (see Section 11 — User Conduct).

Refunds and financial compensation are also not available for losses arising from application crashes, bugs, or technical glitches — see Section 09 (Limitation of Liability) for details.

We strongly recommend thoroughly reviewing your requirements and our proposal before confirming and paying for a project.

Section 06

Intellectual Property

All software, websites, mobile applications, branding, graphics, logos, text, source code, UI/UX designs, APIs, databases, and other materials created by GDF Technologies are the exclusive intellectual property of GDF Technologies and are protected under applicable Indian intellectual property laws, including the Copyright Act, 1957. No individual, organization, developer, agency, or Client may copy, reproduce, modify, reverse engineer, distribute, replicate, or create derivative works from any website, application, design, functionality, or proprietary technology developed by GDF Technologies without our prior written consent.

Clients are granted a limited, non-transferable, time-limited licence to use the final deliverable solely for its intended purpose, for the period specified in the project agreement and any renewals thereof — see Section 07 for full licence terms. Unless expressly agreed in writing, ownership of the source code, proprietary frameworks, reusable components, databases, APIs, hosting infrastructure managed by GDF Technologies, and all underlying intellectual property shall remain exclusively with GDF Technologies. Where the Client provides their own hosting environment, only the deployed application will be delivered, and no ownership of the underlying source code or proprietary technology shall be transferred.

Section 07

Application Licence & Source Code

The compiled application — APK, IPA binary, website, or deployed web output — is licensed to the Client for use for the period specified in the project agreement (the "Licence Term"), and is renewable thereafter.

This licence model applies to all clients, including projects delivered before the effective date shown at the top of this page. Continued use of GDF Technologies' services, support, or website after this date constitutes acceptance of these updated terms, in line with Section 12 (Changes to Terms).

Upon delivery, GDF Technologies provides 2 weeks of complimentary bug and glitch fixes at no additional cost. After this period, further bug fixes, glitch fixes, feature additions, and updates are provided only while the project's licence is active.

If a licence is not renewed, GDF Technologies will not provide any further bug fixes, glitch fixes, feature additions, updates, or other support for the project until it is renewed. Your existing, already-delivered application is not disabled or remotely deactivated as a result of a lapsed licence — it is the ongoing work on it that stops.

Renewal requires payment of the applicable renewal fee, as communicated at or before the renewal date. Where a licence has lapsed and is renewed afterward, reactivation is not instant — it may take additional processing time, and an additional reactivation charge over the standard renewal amount may apply.

GDF Technologies reserves the right to independently develop similar applications, reuse technical implementations, code architectures, UI patterns, feature logic, and development methodologies across multiple client projects. This is standard practice in the software development industry and does not constitute a breach of any client agreement.

Each project is independently developed using GDF Technologies' proprietary internal frameworks and accumulated development expertise. The existence of visually or functionally similar applications developed by GDF Technologies for different clients does not imply that any client's confidential information, trade secrets, or proprietary business data has been shared or transferred.

While GDF Technologies may apply similar technical approaches and feature implementations across projects, each client's confidential business information — including trade secrets, proprietary strategies, sensitive data, and any information shared under an NDA — is strictly protected and will never be disclosed, shared, or transferred to any third party under any circumstances.

A source code licence or full buyout — granting broader, unrestricted rights over the specific codebase delivered, rather than the standard time-limited application licence above — can be arranged at an additional fee tailored to your project. Please discuss this requirement with us directly.

Section 08

Confidentiality & NDA

GDF Technologies treats all project details, business ideas, and client information shared during discussions as strictly confidential. We will not disclose your information to any third party without your explicit consent.

We are happy to sign a mutual Non-Disclosure Agreement (NDA) before any technical discussion takes place. Simply request one via WhatsApp or email before sharing your project idea.

This confidentiality commitment applies regardless of whether a formal NDA is signed, and regardless of whether a project proceeds to completion.

Section 09

Limitation of Liability

GDF Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of revenue, data, business opportunity, or reputation — arising from the use of or inability to use our services.

Our total liability in connection with any project shall not exceed the total amount paid by the Client to GDF Technologies for that specific project.

GDF Technologies is not liable for any loss, damage, or business interruption arising from application crashes, bugs, glitches, or other technical faults, whether occurring during or after the complimentary bug-fix period described in Section 07. The Client is not entitled to a refund or financial compensation for such issues; GDF Technologies' sole obligation is to make reasonable efforts to fix genuine defects while the project's licence is active.

We are not responsible for delays caused by the Client's failure to provide required approvals, materials, or access in a timely manner, or for any third-party service outages beyond our control.

Section 10

Our website and communication channels utilize the following third-party services, each governed by their own terms and privacy policies:

  • WhatsApp (Meta) — Used for client communication. Governed by Meta's Terms & Privacy Policy.
  • Telegram — Alternative communication channel. Governed by Telegram's Privacy Policy.

GDF Technologies is not responsible for the practices, availability, or content of any third-party services.

Section 11

When using our website or engaging our services, you agree not to:

  • Submit false or misleading information in any project inquiry or form
  • Attempt to gain unauthorized access to our systems, data, or infrastructure
  • Use our services for any unlawful, harmful, or fraudulent purpose

  • Commission work that infringes upon any third-party intellectual property rights

GDF Technologies reserves the right to refuse or terminate services for any user who violates these conduct standards, without obligation of refund.

Where a Client publishes false or defamatory content about GDF Technologies, its staff, or its work, GDF Technologies reserves the right to pursue all available legal remedies — including requesting removal of such content from hosting platforms (such as YouTube, social media platforms, or review sites) under their respective policies, and pursuing civil or criminal action for defamation under applicable Indian law, including the Bharatiya Nyaya Sanhita, 2023.

Section 12

Changes to Terms

GDF Technologies reserves the right to modify or update these Terms at any time, at our sole discretion. Changes become effective immediately upon posting the updated Terms on this page with a revised effective date.

It is your responsibility to review these Terms periodically. Your continued use of our website or services after any modifications constitutes acceptance of the updated Terms.

Section 13

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including:

  • The Indian Contract Act, 1872
  • The Information Technology Act, 2000 (and its amendments)
  • The Copyright Act, 1957
  • The Bharatiya Nyaya Sanhita, 2023

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Nainital, Uttarakhand, India.

Both parties agree to first attempt to resolve disputes amicably through direct communication before pursuing formal legal remedies.
